Conditions of the wibutler guarantee

  • Warranty of 2 years
    This free warranty corresponds to the statutory regulation. It begins with commissioning, at the latest 3 months after our delivery, and ends 2 years later.
  • Warranty of an additional 3 years
    This paid guarantee can be agreed by customers with wibutler. It begins 2 years after commissioning, at the latest 2 years and 3 months after our delivery, and ends 3 years later.
  • We guarantee the product owner and the specialised trade company the perfect function and quality of our hardware (here: wibutler pro (2nd gen), article no.: AN01000, model: WG2001, EAN: 4054465806857) through free rectification of defects that are demonstrably attributable to material, design and manufacturing faults within the warranty period.
  • The guarantee supplements claims under warranty / liability for defects and under the Product Liability Act, which remain unaffected. The warranty period is neither extended nor renewed by warranty services.
  • Conditions of the guarantee
    a) Installation, settings and commissioning of the hardware in accordance with the applicable technical regulations and the specifications of wibutler,
    b) regular software updates since commissioning in accordance with wibutler's specifications,
    c) full settlement of our invoices relating to the hardware and the guarantee against payment,
    d) Location and use of the hardware in Germany.
  • Excluded from the guarantee are defects and damage caused by
    a) Incorrect planning and non-observance of the installation, operating and service instructions,
    b) improper modifications and parts of foreign origin,
    c) improper networking with secondary devices that are not officially compatible,
    d) external influences outside the company.
  • Defects recognised by us as warrantable shall be remedied by repairing the defective hardware or replacing it with faultless hardware at our discretion. Replaced hardware (parts) shall become our property.
  • The warranty claim must be made to wibutler within one month of becoming aware of it. The product owner and the specialised trade company must provide all information relevant to the processing of a claim and answer questions truthfully and completely. In the event of a warranty claim, they must provide evidence of the following:
    a) Purchase of a new appliance from wibutler or specialised partners and presentation of the proof of purchase,
    b) fulfilment of the requirements pursuant to section 5,
    c) the invoice for the guarantee claim against payment.
  • Exclusion of further claims
    Claims over and above these terms and conditions, in particular claims for damages, irrespective of the legal grounds, are excluded. This shall not apply in the event of wilful intent or gross negligence or in the event of personal injury. Insofar as there is no intentional behaviour, compensation for consequential damages is excluded, unless the obligation breached by us was specifically intended to avoid consequential damages.
  • Place of jurisdiction and miscellaneous
    All disputes arising in connection with the guarantee shall be subject to the jurisdiction of the courts responsible for Münster.
    German law shall apply. The UN Convention on Contracts for the International Sale of Goods (CISG) is not applicable.
